The following was again before the House in third reading: CS FOR HOUSE BILL NO. 15(RES) "An Act relating to participation in matters before the Board of Fisheries by members of the board and to the definition of 'immediate family member' under the Alaska Executive Branch Ethics Act as that Act applies to members of the Board of Fisheries; and providing for an effective date." Representative Stoltze moved and asked unanimous consent that CSHB 15(RES) be returned to second reading for the specific purpose of considering Amendment No. 1. There being no objection, it was so ordered. **The presence of Representative Hawker was noted. Amendment No. 1 was offered by Representative Stoltze: 2008-01-23 House Journal Page 1779 Page 1, line 1, following "Act" (title amendment): Insert "relating to the membership of the Board of Game;" Page 1, line 8, following "purpose of": Insert "secs. 3 and 4" Page 1, following line 12: Insert a new bill section to read: "* Sec. 2. AS 16.05.221(c) is amended to read: (c) Members of the Board of Game serve staggered terms of three years. The terms of the members of the board begin on July 1. Notwithstanding AS 39.05.080(1), by April 1 of the calendar year in which the term expires, the governor shall appoint a person to fill the vacancy that will arise on the board because of the expiration of the term of a member of the board and submit the name of the person to the legislature for confirmation. If a vacancy arises on the board, the governor shall, within 30 days after the vacancy arises, appoint a person to serve the balance of the unexpired term and submit the name of the person to the legislature for confirmation. A person appointed to fill the balance of an unexpired term shall serve on the board from the date of appointment until the earlier of the expiration of the term or the failure of the legislature to confirm the person under AS 39.05.080 [AND, EXCEPT AS PROVIDED IN AS 39.05.080(4), EACH MEMBER SERVES UNTIL A SUCCESSOR IS APPOINTED. AN APPOINTMENT TO FILL A VACANCY IN THE MEMBERSHIP OF THE BOARD OF GAME SHALL BE MADE IN THE SAME MANNER AS THE ORIGINAL APPOINTMENT AND, EXCEPT AS PROVIDED IN AS 39.05.080(4), AN APPOINTMENT TO FILL A VACANCY IS FOR THE BALANCE OF THE UNEXPIRED TERM]." Renumber the following bill sections accordingly. Page 2, line 20: Delete "sec. 2" Insert "sec. 3" 2008-01-23 House Journal Page 1780 Page 2, line 24: Delete "sec. 7" Insert "sec. 9" Page 2, following line 24: Insert a new bill section to read: "* Sec. 7. The uncodified law of the State of Alaska is amended by adding a new section to read: TRANSITION. Notwithstanding AS 16.05.221(c), as amended by sec. 2 of this Act, the expiration date of the term of a person serving on the Board of Game on January 1, 2008, is March 1 of the calendar year in which the term expires." Renumber the following bill sections accordingly. Page 2, line 25: Delete "Sections 1 and 2" Insert "Sections 1 and 3" Page 2, line 26: Delete "Section 4" Insert "Section 5" Representative Stoltze moved and asked unanimous consent that Amendment No. 1 be adopted. Representative Seaton objected. The question being: "Shall Amendment No. 1 be adopted?"
